General Terms And Conditions For Online Sales.

1. Preliminary provisions

www.univerwall.com (hereinafter the “Site”) is a site belonging to The Cavalli wall Company, a limited liability company (LTD)  with a capital of € 2,000, whose head office is located at Esentepe district, Ressamlar Alley, No.22 Istanbul, Turkey, registered at the Turkey Trade and Companies Register under number 843 932 468 and having with the Intra-Community VAT number 28843932468 (hereinafter ‘univerwall’).

1.2 Identity of the buyer

For the purposes hereof, the term “Buyer” refers to any natural or legal individual purchasing the products and services sold on the Site (hereinafter the “Products”).

1.3. Terms of Sales

The purpose of these General Terms of Sale is to define the terms and conditions for the online sale of the Products and Services on the Site. They can be printed and kept by the Buyer. By checking the corresponding box, the Buyer acknowledges having consulted and accepted these terms explicitly and in good conscience. univerwall reserves the right to modify at any time and without notice the General Conditions of Sale, it being specified that those applicable to the sale are those that the Buyer accepts when placing his or her order.

1,4 Product Information

1.4.1 The Purchaser may, prior to his order, take note on the Site of the essential characteristics and price of the Products he wishes to order. univerwall reserves the right at any time to add new Products, delete products or change their presentation or price. The information on the Products and the prices applicable to the order are those appearing on the Site at the moment when the Buyer validates his order. If a Product ordered on the site should no longer be available, Customer Service will inform you by email to find an alternative solution or to proceed with the refund of the order.

2. Order

2.1. The different stages of the order are as follows:

2.1.1 Order on the Site

The Buyer chooses on the site the motif or visual that he or she wishes to order (or transmits it through the site or directly to customer service) and the information which pertains to it (dimensions of the final print (wall decor or table), or number of the roll (wallpaper), choice of printing material and, if necessary, any additional request and adds it in the “Your basket” section, where he or she may check the details of his draft order and modify it at any time. The Buyer must then validate his or her details, billing address, location and method of delivery and chosen method of payment (among those accepted). From the moment the Buyer confirms his or her order in Clicking on the icon “Validate your payment”, the Buyer is considered to have definitively accepted the content and conditions of his or her order, the prices, characteristics, quantities and delivery times of the Products ordered. The order is then considered definitive.

2.2 Confirmation of the order

univerwall sends the Buyer an email summarizing the terms and conditions of the order. It is recommended that you check this order confirmation to ensure your order expectations are met. If you have any questions, please contact univerwall customer service immediately. Keep the order confirmation accessible in order to ensure you have the necessary information in order to contact customer service.

2.3 Unavailability of Products

In the event of the unavailability of one or more Product after the placing of the order, the Buyer will be informed of the impact on his order at the latest at the time of delivery. Only Products delivered will be charged.

2.4. Cancellation of the order

univerwall reserves the right to cancel all orders for legitimate reasons in accordance with Article L 121-11 of the Consumer Code and in particular:
– abnormal orders, abnormally repeated orders;
– in cases where the information provided by the Buyer is incomplete or inaccurate;
– in case of default of payment or partial payment of sums due by the Buyer.
In case of a quality problem with the received good(s), the Buyer will be required to contact customer service, who will then closely examine the discrepancy and proceed toward an exchange if it is actually a fault related to the realization of the ordered good. All products with apparent defects related to production or printing will be replaced.
We do not offer refunds on custom products (bespoke wallpapers, bespoke wall hangings, customized paintings and/or customized posters, custom designs).
 
3. Prices
 

The selling prices of the Products are indicated in euros, all taxes included at the rate in effect on the day of the order and excluding shipping costs, the amount of which depends on the option chosen by the Buyer. eazywallz.eu reserves the right to modify its prices at any time, it being understood however that the price appearing on the site the day of the order will be the only one applicable to the Buyer. The price excludes any import taxes and/or customs duties applicable in your country, which remain the responsibility of the Buyer.

4. Payment terms

 4.1 Payment of orders can be made by credit card belonging to one of the CB, Visa, Mastercard, or American Express card networks. The debit will take place at the time of the online order confirmation. It is recalled that in accordance with Article L.132-2 of the Monetary and Financial Code, the commitment to pay given by means of a bank card is irrevocable. By communicating the information relating to his or her credit card, the Buyer thereby authorizes the debit of his  or her credit card. The Buyer must send his credit card number, the expiry date thereof and the cryptogram number (3-digit number on the back of the credit card or 4 digital number on the front of the card in the case of American Express issued cards).

 4.2 The entire transaction is carried out in encrypted mode, and the Buyer’s banking data do not pass through the Website, but rather through the STRIPE payment platform that secures payments and prevents credit card fraud. univerwall reserves the right to verify the reliability of the information entered by the Buyer by requesting a voucher such as a copy of his or her identity card by e-mail or by standard mail which will have the effect of suspending the Order. In the case of absence of transmission or nonconformity of these vouchers, univerwall reserves the right to cancel the Order without any compensation of any kind whatsoever may be claimed by the Buyer. In order to facilitate the shopping journey on the Site, the Buyer will be able to securely save his bank details in encrypted mode via the “One-click payment” option. In the event that the Buyer no longer wishes to leverage the “One-click payment” option, he may at any time delete his banking data or create and/or add new data coordinates.

 4.3 The Buyer may pay for his orders through PayPal provided that he has an account with PayPal. It is specified that these are the Terms of Use of PayPal that apply.

 5. Shipments

 5.1 Delivery methods

 Products may be delivered to any country except Canada and the United States. The Buyer may choose, when ordering, among the delivery methods proposed, the one that is most suitable for his or her needs. The products are shipped in a rigid packaging of very high quality for maximum protection of the goods contained therein. The products purchased on the univerwall website are delivered directly to you or your company from the production center, without intermediaries.

 5.2 Delivery times

 The delivery time of the Products depends on the option chosen by the Buyer when placing an order. We strive to deliver orders and services quickly. In any and all cases, whether out of stock or force majeure, the Products will be shipped to the Buyer no later than five (5) business days after confirmation of the order. In any and all cases, a possible delay does not entitle the Buyer to claim damages. In the event that the Products are returned to univerwall because the Buyer has not taken possession of the package containing the products, the Buyer must contact univerwall Customer Service to arrange a new delivery at his or her own expense. No refund of Products will be made.

 5.3 Order verification upon receipt

 The Buyer must immediately check the condition of the package in order to be able to issue its reservations directly to the carrier at the delivery of the package. No further claims on the condition of the parcel can be made to univerwall Customer Service. The Buyer must then check the conformity of the delivery with his or her order and inform the univerwall Customer Service as soon as possible of any discrepancy or non-conformity.

 6. Quality of Products

 The Product(s) must be inspected before installation. Any and all defect(s) must be reported to univerwall Customer Service; claims may not be made or filed after the Product has been used or installed. Installation costs are not reimbursed, so please carefully check the condition of your Product before putting it on or fitting it to any area.

Slight variations in colour may occur between prints; we can offer replacements only if it is admitted that the differences are clearly visible.

Colour variations may appear between the on-screen preview and the physical product. We may not be held responsible for discrepancies between monitor settings. In the case where it is important that the colours should match, we can send you a sample printed on an already paid order, before the final print begins in order to ensure that the colours are suitable. Claims for colour differences can and will not be made unless the printed sample has been requested and approved in advance of printing.

 7. Right of withdrawal and returns

In the event of a quality problem with the Product received, you must contact the univerwall Customer Service Department, which will examine the discrepancy and proceed to an exchange if it is actually a defect related to the production or printing of the ordered Product. All Products with apparent defects related to production or printing will be replaced.

univerwall does not offer refunds on personalized products (wallpapers, wall decorations, custom posters and paintings, custom designs). univerwall does not reimburse any additional costs that may arise due to a product that is damaged or defective, such as overtime labour, materials or otherwise. It is up to the customer to check the Product before installing or utilizing it. univerwall does not reimburse any damage that may be caused during installation or utilisation.

 8. Limitation of liability

 8.1 The responsibility of univerwall can not be held liable for damage resulting from a fraudulent intrusion by a third party having caused a change in the information made available on the Site, in case of fault of the Buyer, or in the case of force majeure as defined by the law and the Courts,

 8.2 In the event that univerwall’s liability should nevertheless be retained for any prejudice suffered by the Buyer as a result of the non-performance or improper performance of its services, the latter shall be limited to the amount of the order paid by the Buyer to univerwall.

 9. General

 9.1 The fact that univerwall does not claim from the Buyer of a provision of the General Conditions of Sale may and will not be interpreted as a waiver to invoke or evoke this provision.

 9.2 If any provision of the General Terms and Conditions of Sale is declared void in whole or in any part, the other provisions and other rights and obligations arising from these Terms and Conditions remain unchanged and will remain applicable in their entirety.

 9.3 In general, it is expressly agreed between univerwall and the Buyer that e-mails are valid between the parties as well as the automatic registration systems used on the Site, particularly as regards the content and date of the command.

 The collected information is a matter of computer processing necessary for the management and the follow-up of orders (including the taking of order, the invoicing, the shipping, the claim, the after-sales service), the management of the notices of the consumers on Products, services, purchased content and management of consumer accounts (including commercial animation, prospecting, statistics). The recipient of this data is univerwall and its service providers for the execution of the Order. The data may be transmitted to partners selected by univerwall for the purpose of managing the consumer accounts. These data will be kept for a period of time to comply with univerwall’s legal obligations. In accordance with the regulations on the protection of personal data (including Regulation (EU) 2016/679 of 27 April 2016), the Buyer has a right of access, rectification, deletion, data portability, of limitation or opposition to its processing by sending an e-mail in the “Contact” section or by letter, accompanied by a photocopy of his or her identity document, to the following address: univerwall, Customer Service, Esentepe district, Ressamlar Alley, No.22 Istanbul, Turkey.  11. Information pertaining to cookies

 This site uses a cookie session to keep track of users so that the server does not confuse baskets, clients, etc. The cookie does not store any user information.

12. Intellectual and Industrial Property Rights

 It is strictly forbidden to distribute, modify, transmit or reproduce the Site, in whole or in part, in any form whatsoever.

 13. Applicable law / jurisdiction

 13.1 These general conditions of sale are subject to French law.

 13.2 The Buyer may use consumer mediation to resolve any dispute that he or she may have with univerwall, subject to (i) first having entered the univerwall Customer Service claim in writing and following that no solution has been found and (ii) his or her referral is not manifestly unfounded or abusive.
